Buyers are Now Required to Sign a "Buyer's Contract"


As of August 17, 2024, real estate buyers in Florida will be required to sign a written agreement with their broker before touring homes, including virtual tours. This agreement is called an Exclusive Buyer Brokerage Agreement, and it's intended to outline the services the broker will provide and how they will be compensated. The agreement also includes disclosures required by the National Association of Realtors (NAR) settlement of class action lawsuits in March 2024.

At Team Renick, our philosophy has always been centered around trust and service, not contracts. While buyer agreements have long been available and often required by other Realtors, we've never felt comfortable with that approach. Instead of binding our clients through a contract, we believe in earning your trust by delivering exceptional service, so you want to work with us.


That commitment remains unchanged. However, due to new regulations, all Realtors, including us, are now required to have our buyers sign an agreement. While this is mandatory, rest assured that our approach to serving you remains the same. We will guide you through the process, ensuring that the agreement we select is the one you feel most comfortable with.


What Does This Agreement Mean for You?


The newly required Buyer’s Representation Agreement is simply a formalized contract between you and your Realtor. It outlines the roles, duties, and responsibilities that your agent owes you as you embark on the journey to find your new home.

In Florida, there are four different agreements that we can use:


  1. Exclusive Buyer’s Broker Agreement

  2. Property Pre-Touring Agreement

  3. Showing Agreement

  4. Retainer Agreement

Each agreement has its own pros and cons, and at Team Renick, we are committed to explaining each one in detail. Our goal is to ensure you fully understand the differences and select the one that best fits your needs.

This agreement will also detail the broker commissions to be paid, whether by you or the seller. It's important to note that whatever commission is outlined in the agreement is the maximum amount your agent can receive.

Do I Have to Pay a Commission?


Not necessarily.


With the new NAR ruling, the MLS will no longer advertise cooperating broker and buyer broker commissions. What this means is that the listing agent can no longer display the seller-paid buyer’s agent commission on the MLS. Sellers may or may not choose to offer this form of compensation.


As a result, your agent may not always know upfront whether they will be compensated by the seller when showing you a home. While commissions are negotiable, there are multiple ways your agent can be paid—either by the seller through direct compensation or concessions, or by the buyer out of pocket, as specified in the Buyer’s Representation Agreement.
